Core Reasons to Deny the Hayes Petition to Rezone

  1. The proposed development presents an unnecessary risk to the safety of our drinking water supply.
  2. The overlay of a Planned Unit Development on an O-1 Greenbelt zoning is an incorrect application of the PUD Ordinance. This is a change in the principle use of the property. The PUD cannot be used in this instance.
  3. Putting a commercial development on land zoned O-1 Greenbelt is unprecedented. The proposed commercial development is expressly not permitted in a Greenbelt designated zone.
  4. The Petition to Rezone is not in accordance with a Comprehensive Plan as specifically required by the zoning process.
  5. No Independent Market Saturation Analysis has been performed to ensure the elasticity of the local economy.
  6. As a result of the capricious nature of the notification process, the Planning Staff Report is not an accurate representation of neighborhood input.
  7. Past decisions have sided in favor of the concerns of neighbors opposed to commercial intrusion. Approval of this Petition would be Spot Zoning.
  8. The Wellhead Protection Ordinance was submitted before the Hayes Petition to Rezone, and should have been considered in order.
  9. There is no legally binding written assurance that the remainder of the property will be preserved in perpetuity. The Hayes organization has expressed, before Council, that they would not consider a Conservation Easement on the property and that to do so would be unconscionable. This is the clearest indication of the intent of the Hayes Board.
  10. Destruction of greenspace is contrary to the Mission Statement and Articles of Incorporation of the Stanley W. Hayes Research Foundation, Inc.
